GENERAL TERMS OF USE OF THE GYM

The "Gym," provides gym services to its members upon registration, by paying the relevant fee. The use of services provided by the Gym to its members is subject to the current Terms of Use, as applicable at any given time, which are an integral part of the service contract between the gym and the member who registers to use its facilities.

  1. Provided Services - Gym Subscription
    1.1. The provided services included in each subscription package, the duration of each package's use, as well as their respective fees, are detailed comprehensively on our website and in the price list posted in the gym's reception area. The purchase or renewal of a subscription package implies mutual acceptance of the terms described herein.

  2. Location, Method, and Timing of Service Provision
    2.1. The execution of the contract may begin upon fulfilling the terms mentioned, completing the individual member profile if the member is new, and making the payment to the gym. The agreed-upon services will be provided exclusively at the gym, unless otherwise agreed, in accordance with the gym's operating hours and the hours of group programs in various gym rooms. The gym reserves the right to modify its schedule and room availability without prior notice. Members are required to check daily updates on the gym's website and social media for any changes in the exercise program.

  3. Registration of New Members
    3.1.
    The personal information of the member is provided to the Gym during the member's registration and upon signing this agreement. The member must promptly inform the gym of any changes to their personal information.

   3.2. Registration is allowed only for adults. Registering a minor as a member and renewing a subscription can only be done by a person responsible for their care or guardianship, who must sign the service contract on behalf of the minor.

   3.3. Every member, during registration, must provide a medical certificate from a Pathologist or Cardiologist, confirming their physical ability to exercise and, specifically, their ability to participate in the specific activity or service each time. A corresponding certificate should be provided every 12 months. It should be noted that for pregnant individuals, an additional medical certificate from their gynecologist is required, confirming their ability to exercise or participate in the specific activity each time. In case these medical certificates are not submitted within seven (7) days of activating the member's subscription, the gym reserves the right to deny the member's access until the certificates are provided.

    3.4. The member is obligated to inform the gym of any medical problems or peculiarities they may have, assuming exclusive responsibility for any health problems or medical recommendations/warnings prohibiting the use of the gym in case of non-disclosure.

    3.5. The advice and instructions from the gym's trainers do not constitute medical advice and, in no way, replace it.

4.Payment Methods
    4.1. Payment for the subscription and fees can be made at the gym's premises or electronically through the Gym's website, either in cash or by credit/debit card. By accepting these terms, the fee is considered irrevocably accepted as fair, reasonable, and commensurate with the services provided.

5. Right of Withdrawal, Termination of the Contract

5.1. Right of Withdrawal

The consumer-member has the right to unilaterally withdraw from the contract without justification within thirty (30) calendar days from the day following the signing of the service contract as described above. The exercise of this right by the consumer-member takes place through a written declaration from the consumer-member to the gym. In the case of withdrawal, the consumer-member is obligated to pay for the services that have been demonstrably provided to them. The refund of the money for services not provided is made upon receiving the withdrawal, either in cash or by deposit into a bank account specified by the consumer-member to the gym.

 

5.2. Termination of the Contract by the Gym

The gym reserves the right, in the event of a breach of its internal operating regulations, a breach of any of the terms of this contract, which are all considered essential, as well as in cases of force majeure, emergencies, and unforeseen circumstances, to unilaterally and without liability terminate the contract at any time.

 

6. Gym Operating Rules

During the use of the gym, the member is required to respect the gym's internal operating rules, which are detailed below, and which are deemed to be known and unconditionally accepted upon the purchase of a subscription package.

 

MEMBER REGISTRATION – SUBSCRIPTIONS - RESERVATIONS

6.1
. Each member is required to provide a medical certificate from a Pathologist, Cardiologist, or general practitioner upon registration, confirming their physical fitness for exercise. This certificate must be renewed every 12 months (Law 3057/02). Additionally, members are obliged to inform the trainers of any exceptional health issues they may be facing. In the event of not presenting the medical certificate, the gym reserves the right to suspend the member's participation in gym classes. Each subscription is personal and pertains to the member specified on the respective receipt.

6.2. Reservation of slots for all gym programs and services is mandatory for members. Reservations can be made through the website or by contacting the gym's administration via phone, social media, or email.


6.3. Prior to the start of any class, each member must confirm their attendance at the reception or with the trainer.


6.4. Cancellation of a reserved class slot is prohibited within a period of less than 24 hours before the scheduled class time. In this case, the member will be charged for the class even if they do not attend. The gym assumes no responsibility towards its members for the unavailability of slots in classes or the unavailability of equipment.


6.5. It is the gym's policy not to offer refunds for the sale of any service.

USE OF FACILITIES


6.6. The use of the gym is not allowed for individuals who have not settled their financial obligations with it.

6.7. Visitors accompanying gym members must remain in the gym's waiting area unless they request assistance from the facility's staff.


6.8. Entry to individuals under the age of 13 is strictly prohibited in the adult exercise areas without adult supervision

 

6.9.  Members are expected to display appropriate behavior while in the gym's premises. They should respect the peace and dignity of other members and the gym's staff. Members must not disturb others in any way. Specifically, shouting loudly, using offensive or indecent language, threatening, engaging in physical violence, insulting, harassing, or obstructing other members or gym personnel is not allowed. Even a single violation of this rule is sufficient for the gym to consider terminating the membership of the member who violates it, which would require a relevant recommendation. Any complaint should be reported individually or in writing to the gym's administration.


6.10. The use of gym equipment and exercise machines must be done with care by gym members and always following the instructions of the trainers. Any weights, such as dumbbells, plates, bars, mats, or other gym equipment, should be returned to their designated positions after use.


6.11. Members must always adhere to the instructions of the gym trainers. Non-compliance by a member gives the trainer the right to request the member's departure from the class.

 

6.12. It is the responsibility of gym members to inform the staff of any potential medical issues they may have and to comply with the gym's policies regarding such issues.


6.13. Members are required to maintain personal hygiene while in the gym and to change clothing after intense sweating.


6.14. The use of a towel is mandatory on all equipment that involves bodily contact.


6.15. Removing shoes is mandatory in the class areas.


6.16 . Members must clean the equipment they used at the end of the class with the antiseptic wipes provided by the gym.


6.17. The members of the gym must take care of the cleanliness of its premises and not pollute it.


6.18. The consumption of food and drinks (except sports drinks and water) outside the reception area is prohibited.


6.19 . Smoking is prohibited in all areas of the gym.


6.20. The use and/or trafficking of illegal substances within the gym is strictly prohibited.


6.21. It is strictly forbidden to sell food supplements inside the gym.


6.22 . The use of the lockers is allowed to the members of the gym only during their stay in it. It is expressly forbidden to maintain their insurance after using the gym and leaving it. The gym reserves the right to unlock and empty all lockers after members leave the gym, excluding any liability for loss of items.


6.23. The gym does not provide a storage service for members' personal belongings and under no circumstances will the reception staff store them.


6.24. Gym members are personally responsible for the safekeeping of these items and the gym advises its members not to bring valuables into the gym.


6.25. The gym is not responsible in case of theft of items, money or personal belongings of the members in the locker room or in any other area of ​​the gym.


6.26 . The use of cell phones is prohibited during group programs.


6.27. The member must take into account the safety measures of the building to avoid accidents.

6.28 . Any damage to an object caused by the member's fault is the responsibility of the member who caused it, and must restore it. This also applies to any damage to the gym equipment if it is used contrary to the instructions of the gym staff


GENERAL TERMS
6.29.
The gym reserves the right to cancel the registration-subscription of a member who has violated the above regulations, in which case the member's payments that have been made until then will be forfeited. In order for these consequences to occur, a relevant email is sent to the member.


6.30 . The company may record video footage or take photographs for the purpose of displaying it on social media after receiving the consent of the persons pictured.


6.31 . The management of the gym reserves the right to change the opening hours of the gym as well as its individual departments and the gym is not liable to the members for any changes. The management of the gym reserves the right to change its price list.


6.32. The music played in the gym is a choice of the gym management and only the
gym.

7. Dispute Resolution & Jurisdiction


7.1. For any dispute arising from this and the drawn up contract, it is possible to resolve disputes out of court by appealing to the Amicable Settlement Committees or the Consumer Advocate. In any case, to deal with any dispute that may arise from this and the drawn up contract, the courts of Athens are designated as competent.

11. Legal Basis of Processing


11.1 . For the conclusion of a service contract: the correct execution of the service contract or the taking of measures in accordance with the data subjects before the conclusion of the contract.

 

11.2 . For the record keeping of the special training cards: The compliance of the Responsible Processing with its legal obligations, in accordance with article 3 par. 9 of the P.D. 219/2006.

11.3 . For the formulation of a special fitness program: the processing is necessary for the purposes of preventive medicine and assessment of the exerciser's ability to exercise.


11.4 . For information via newsletter: Your consent.


11.5. To download photos/videos: Your consent


12. Personal data of minors


12.1 . The registration of minor trainees and the processing of their personal data is legal only with the additional written consent of the persons exercising their parental care.


13. Consent of the Athlete to take photos/videos:


13.1. I give my consent to the taking of photos/videos inside the Gym area for the purposes of safety and protection of persons and goods as well as for the purposes of commercial promotion/advertisement of the Gym.

 

14. Data storage period


14.1. Up to five (5) years from their receipt by the Controller.

15. Recipients


15.1. Employees of the Company. Health data are transmitted exclusively to the company's specialist scientific partners (Trainers, Gymnasts, Trainers).


15.2 . External partners of the Company (Accountant, Technical Support Staff) to whom the health data of the trainees are never transmitted.

16. Transmission of personal data


16.1. Personal data is not transferred to third countries or international organizations.


16.2. No personal data is transmitted for any commercial purpose not mentioned herein.

17. Rights of subjects


17.1. Right of access to the personal data concerning you and as long as these are being processed by the Data Controller.

17.2 . Right to correct inaccurate data as well as to complete incomplete data.

 

17.3. Right to delete your personal data, subject to the obligations and legal rights of the Controller.


17.4. Right to restrict the processing of your personal data.

These include third parties' cookie collection policy, which is beyond our control. However, if you do not view this content, no third-party cookies are installed on your device.


18.4.3.The third party providers can be changed by revising the cookies policy of the gym's website


18.5. Obtain User Consent:

18.5.1. The mandatory acceptance of cookies is not a condition of entry to our website, however blocking all cookies will have a negative effect on the functionality of the website.


18.5.2. The user, as the case may be, can navigate freely by checking and accepting or not the cookies, either of the Gym's website, or of third parties, whose usage policy is determined exclusively by them, without the involvement of the Gym and legal liability.


18.5.3 . Next to the button to accept each cookie there is a link that leads to the present cookie policy of the website of the Gym, in which each user can read all the necessary information, which will facilitate him to make a decision to grant consent or not to accept cookies .

19. Manner of exercising rights

19.1 . Each of your requests regarding the personal data concerning you and the exercise of your relevant rights must be addressed via email to the Data Controller.
